Samantha Rothaus is a partner at Davis+Gilbert LLP, where she has a wide-ranging transactional and advisory practice in the advertising, media and marketing communications industry. She helps agencies and advertisers draft and negotiate talent and influencer agreements, endorsement deals, sponsorship agreements, content production contracts and related licenses and releases for production of commercials and other brand content. She also spends a lot of time advising clients how to navigate the use of generative AI and other emerging technologies to produce content for advertising, public communications and promotional purposes. Samantha routinely supports clients in developing and executing 360-degree marketing campaigns and promotional programs to ensure compliance with regulatory requirements and industry standards. This includes reviewing content and advising on advertising claims, legal disclaimers, talent and IP clearance issues, promotions law issues, and identifying and navigating other obstacles. In addition, she often advises clients on entertainment production matters in connection with film and television projects, including non-scripted, documentary and animation projects.
Clients she works with include advertising and marketing agencies, PR/communications firms, media companies, production companies, independent filmmakers and musicians, and advertisers in the automotive, fashion, design, food/beverage and consumer products industries.
Prior to joining Davis+Gilbert, Samantha was an intellectual property litigator with focus in brand protection and trademark prosecution. She received her J.D. from Boston University School of Law with a focus on intellectual property law, and received a masters of law degree in entertainment and media law from UCLA. She lives and works in New York City.
